Zane Ērmanis versus Mīle Ķepītis and Jānis Dadzis

Here copies of 3 protocols of Trikāta pagasts court sessions are published. The copies were sent to the Pastor Keussler to inform him what the decision of the court was in the case of Mīle Ķepītis who was accused of depravity by Zane Ērmanis.

Three sessions were needed to investigate the case. Here you find protocols of all sessions. For better understanding, I typed the translations after each one of the sessions. Some comments concerning problems touched in the court sessions can be found in another Page.

The court of Trikates castle pagasts
5. July 1884

Upon the query Nr.260 of June 18 by the Pastor of the parish Mr. Keussler, which obliged the pagasts court to investigate the claim of Zane Ērmanis from Kūkuri farm against Mīle Ķepītis from the same farm on her depravity and thereafter to deliver a copy of the investigation protocol to the Pastor of the parish. Zane Ērmane, now living in Pautiņi farm of Plāņu pagasts, was summoned to the court together with her brother Jānis Ērmanis as the representative, and she was demanded to report what she knows of the case and in what way Mīle Ķepītis leads the depraved life?

Zane Ērmanis reported that Jānis Dadze some evening before the Pentecost came to the farm to visit girls and knocked the door asking to let him in, hereat Mīle Ķepītis asked who is he and she answered that he is Jānis Dadzis whom she recognized because in the previous year they both lived in Ratnieku farm. Hereat Mīle Ķepītis said to let him in and she opened the door that was locked by a bolt. And Jānis Dadzis at once took the coat off and went and laid himself down on the bed where Mīle Ķepītis was laying. At the beginning she sit on a chair and when Mīle Ķepītis proposed she went and laid down on the side of the same bed. Some time later Mīle Ķepītis and Jānis Dadzis talked that Zane was sleeping well and when she answered nothing they were up to mischief.

Jānis Dadzis was laying down on Mīle Ķepītis all the time, to what Mīle Ķepītis asked Jānis Dadzis not to make her too heavy hereat Jānis Dadzis answered that it is nothing special she can easy put up with it. She, Zane Ērmane, could not undergo in the bed, stood up and went out, whereat Jānis Dadze asked her why she went out might be she has heard something, whereat she answered she has heard all, whereat Jānis Dadzis asked her not to tell anybody about this, something like this happened to him just for the first time, that he has committed such disgraceful things and he added that Mīle Ķepītis is of no worth because is like an old woman. She went then to the house room and when the other maid Anna Bertulsone, whose bed she wanted to sleep in, asked why she did not sleep in klēts, she explained the reason. She also said that Mīle Ķepītis explained that Pēteris Markus from Bāzes farm taught her that no sequel would happen, if the wetness was not let in, and that Anna Bērtulsone who was nearby also heard what was said, and that Mīle Ķepītis also said that the guys from Trikāte who visited her also followed this way and she found nothing better; Pēteris Markus from Baize farm and Jānis Tilcēns from Daibes farm once in winter pulled her on the side of a bed and played with her saying that in the middle of the soft bed it is not so cozy to do this.

The summoned maid Mīle Ķepītis together with her father Pēteris Ķepītis expressed that really Jānis Dadzis once visited her, but they were virtuous, and that with the other guys she had done no mischief, that she really told the doctor in Smiltene she laid with men, but she did not say she was exploited, which the doctor misunderstood. As well she did not tell the maids Zane Ērmanis and Anna Bērtulsons that Pēteris Markus from Bāzes farm taught her how to avoid the consequences when one played like this, Pēteris Markus nothing taught her and she knew nothing in these matters. She did not also know what Zane Ērmanis complained about that Pēter Markus from Bāzes farm and Jānis Tilcēns from Daibes farm in winter had done with her, that was a complete untruth.

The summoned maid Anna Bērtulsons with her father Jānis Bērtulsons said that all the people in the farm heard when at the next day Zane Ērmanis said that Jānis Dadzis and Mīle Ķepītis were busy with unchastity. Mīle Ķepītis once actually told her that the guys, whose names she does not remember now, taught Mīle how to be safe. She knows nothing more in this case.

The summoned Pēteris Markus from Bāzes farm expressed that he never visited girls in Kūkuri farm and that he knew nothing about as if he taught Mīle Ķepītis how to be safe when one was dissolute. He has never slept with Mīle Ķepītis.

The summoned Dāvis Kazaks said that he knew nothing more in the case except once in another time in the morning when he was sleeping in the klētiņa of Kūkuri farm he saw Jānis Dadzis entered the klētiņa and spoke with him. Whether he also visited the girls, he does not know.

The summoned Zane Ērmanis together with her brother Jānis Ērmanis said that Jānis Dadzis and Mīle Ķepītis were busy with whoreship that time what she said at the first session, but she never kept whoreship with him neither in Ratnieki farm nor in another place, she is yet an innocent virgin and know nothing on the men, she can prove the assertion by the certificate of the doctor if the pagasts court will refer her to him.

The summoned Jānis Tilcēns insisted that he had never committed any mischief with Mīle Ķepītis, and he never visited girls in Kūkuri farm.

Jānis Dadzis was summoned and demanded how he could have the courage to defame Zane Ērmanis in this manner, and he answered the same as at the previous time that he has been sexually exploiting Zane Ērmanis for two years.

Zane Ērmanis together with her brother Jānis Ērmanis as her representative was summoned, and the certificate of the doctor was presented, then she demanded 5 Roubles in silver for each of two trips to Valka, because the horse had to be hired, and the second trip was needed, because when she for the first time arrived at the doctor at the same time blood occurred on her clothes and the doctor could not investigate her.

As Jānis Dadzis had the courage to argue against the certificate of the doctor of Valkas apriņķis Dr. Ullmann, saying that the doctor could write what he wanted but he himself could swear he had exploited Zane Ērmane and in this manner he defamed the highly educated man, the court

Jānis Dadzis for defamation of the chaste maiden Zane Ērmanis should be arrested for twenty four hours two times and should pay in 14 days to Zane Ērmanis for two trips to Valka for each trip 3 Rbl. silver, totally 6 Rbl. silv.

Mīle Ķepītis for unchaste life should pay 2 Rbl. silv. of fine in 14 days for the pagasts cash of the poor. - and it was

To send a copy of this protocol to the Crown Valka Order Court together with a petition asking it to wish to take in its consideration and decision the case of the calumny of apriņķis doctor Dr. Ullmann.
