Highway code in 1805

The document presented in this Page informs about the legal consequences of road accidents in 1804. Actually the document consists of two parts. The first part is the letter of Livland's governor J. von Repief to the population of the province. The letter informs about the order of the Tzar to the Minister of the Interior Prince Kurakin. It also contains the order to the town Police officials to supervise the fulfillment of Tzar's order.

The second part of the document is the actual letter of the Tzar to A.B.Kurakin. Below only this second part is published. As far as I understand, the letter was translated in German by St. Petersburg's clerks and cascaded to Livland's officials.

Fürst Alexei Borissowitsch! Nachdem ich aus den Unterlegungen ersehen, daß von dem ungestümen Fahren in mehreren Städten sich mancherlei Unglücksfälle ereignen; so befehle Ich zur Abhelfung solcher Unordnungen für die Zukunft:

1) In allen Gouvernements und Kreisstädten sollen, wenn von dem schnellen Fahren sich irgend ein Unglücksfall ereignet, die Kutscher dem Gericht übergeben, und die Pferde, gleichwie dies in den beiden Residenzen geschiehet, zu der Artillerie-Jurisdiktion, wo es aber eine solche nicht giebt, zum Besten der Orts-Polizei, abgenommen werden.

2) Diejenigen, welche von einem solchen Fahren eine Beschädigung erlitten haben, sollen in den Stadtkrankenhäusern auf dessen Kosten, der in der Equipage gefahren, geheilt werden.

Sie werden nicht unterlassen, über die Erfüllung dessen, an wen es gehörig, Vorschriften zu erlassen.

Prince Alexei Borisowitch! Since I have learned that accidents have sometimes occurred in a number of towns caused of impetuous driving, so I order for the future preclusion of this disorder:

1) If in any province or apriņķis capital an accident has occurred because of fast driving, then the coachman should be brought to trial, and the horses should be delivered to artillery forces, if the accident took place in one of both capitals, but if it occurred in the places where there are no artillery forces, then to the local Police.

2) Those who have been damaged in these accidents should be treated medically in the town hospitals at the expenses of the passengers of the carriage.

You are not refrained to issue regulations in due cases for fulfillment of this order.
